JORDEN BURT ALERT: Ninth Circuit Issues Widely Anticipated Decision in Massive Class Action Lawsuit

A sharply divided Ninth Circuit Court of Appeals on April 26, 2010, issued its blockbuster, 137-page en banc majority and dissenting opinions in Dukes v. Wal-Mart Stores, Inc. The lawsuit is generally acknowledged as the largest employment discrimination class action in United States history. The class, composed of a "broad and diverse" group of female employees employed at Wal-Mart stores across the country, asserts sex discrimination claims under Title VII of the 1964 Civil Rights Act.
