He focuses his practice on the representation of individuals and corporations in complex civil and criminal litigation at both the trial and appellate level. Mr. Gerstin litigates class action and individual cases on behalf of insurance companies, financial institutions and other sophisticated commercial entities in state and federal courts. He also devotes a significant portion of his practice to the representation of clients in white collar matters, including government investigations and grand jury proceedings.
Mr. Gerstin has litigated civil matters involving claims arising under state unfair trade practices and consumer protection laws, the federal Racketeer Influenced and Corrupt Organizations Act and equivalent state laws, and common law. In the white collar area, Mr. Gerstin has assisted clients with matters involving allegations of mail fraud, wire fraud, money laundering, obstruction of justice, and regulatory violations. - Everhart v. Citizens Property Insurance Corp. (Circuit Court, Leon County, Fla. 2011), dismissal of class action; on appeal to Florida's 1st District Court of Appeal.
- Castellanos v. Citizens Property Insurance Corp. (Circuit Court, Miami-Dade County, Fla. 2010), dismissal of class action; on appeal to Florida's 3d District Court of Appeal.
- United States v. McQueen, 2011 WL 4375729 (S.D. Fla. 2011), dismissal of obstruction of justice charges brought under 18 U.S.C 1519 and 18 U.S.C 1512(b)(3).
- United States v. Gonzalez, 718 F.Supp.2d 1341 (S.D. Fla. 2010), order granting motion in limine to exclude testimony of federal district court judge from trial of obstruction of justice and perjury charges arising from the defendants' testimony before the district judge whose testimony was excluded; the defendants were subsequently acquitted of all charges at trial.
- United States v. Perraud, 672 F.Supp.2d 1328 (S.D. Fla. 2009), dismissal of obstruction of justice charge brought under 18 U.S.C. 1505.
